Klinix Capital Insurance Inc. ("Klinix Capital Insurance," "KCI," "we," "us," or "our") is a licensed insurance agency organized under the laws of the State of Delaware and licensed to transact insurance business in Texas (TDI License No. 3480549, NPN 22164426). This Privacy Policy describes how we collect, use, share, and protect personal information obtained through our website at klinixcapitalinsurance.com (the "Site") and in connection with the insurance products and services we offer (collectively, the "Services").
This Policy applies to consumers, insurance applicants, policyholders, and visitors who interact with our Site or inquire about our Services. By accessing or using our Site, you acknowledge this Privacy Policy. If you do not agree, please do not use our Site or Services.
Capitalized terms not defined herein have the meanings ascribed in the Klinix Capital Insurance Terms of Service.
IMPORTANT: As a licensed insurance agency, Klinix Capital Insurance is subject to state insurance privacy regulations, the federal Gramm-Leach-Bliley Act (GLBA), and the NAIC Privacy of Consumer Financial and Health Information Regulation (Model #672). This Policy serves as our initial and annual privacy notice to consumers as required by those laws.
Our Site and Services are intended for individuals who are at least eighteen (18) years of age. We do not knowingly collect personal information from persons under the age of thirteen (13). If we learn that we have collected personal information from a minor under 13, we will take reasonable steps to delete such information promptly.
If you are under sixteen (16) years of age and believe we hold information about you, you may request removal by contacting us at the address below with the subject line "Removal of Minor Information."
Section 03As a licensed insurance agency, we are subject to the Gramm-Leach-Bliley Act (GLBA) and the NAIC Privacy of Consumer Financial and Health Information Regulation (Model #672), adopted by Texas and other states where we operate. These laws require us to provide you with notice of our privacy practices with respect to nonpublic personal financial information ("NPI").

To the extent we share NPI with nonaffiliated third parties for purposes beyond those described above, you have the right to opt out. To exercise this right, contact us using the information in Section 14. We will comply with your opt-out request within a reasonable time.
Section 04PLEASE NOTE: Do not submit Protected Health Information (PHI), Social Security Numbers, driver's license numbers, financial account numbers, or other sensitive personal data through the website contact form. These should only be submitted through secure, designated channels during a formal insurance application process.

You may opt out of marketing communications at any time by following the unsubscribe link in any email we send, or by contacting us directly. Opting out does not affect transactional or service communications required by law or contract.

Section 08We retain personal information for as long as necessary to fulfill the purposes for which it was collected, comply with applicable law (including state insurance record retention requirements, which typically require policy records to be retained for a minimum of five years), resolve disputes, and enforce our agreements.
We implement administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, use, disclosure, alteration, or destruction, consistent with the NAIC Insurance Data Security Model Law (#668) and the GLBA Safeguards Rule. These include encrypted data transmission, access controls, and regular security assessments.
In the event of a data breach involving your personal information, we will notify you as required by Texas Business & Commerce Code Section 521.053 and any other applicable state breach notification law.
Section 10As a licensed insurance agency that assists clients with health insurance placement, Klinix Capital Insurance may receive information that constitutes Protected Health Information (PHI) as defined under HIPAA when acting as a Business Associate of a covered entity (such as a health insurance carrier or employer-sponsored group health plan). In such capacity, we use and disclose PHI only as permitted under applicable Business Associate Agreements and HIPAA regulations.
Our separate HIPAA Notice of Privacy Practices describes our obligations and your rights with respect to PHI.
DO NOT submit PHI through our website contact form. If you need to share health-related information as part of an insurance application, your agent will provide you with a secure, HIPAA-compliant channel for doing so.
Residents of certain states have additional privacy rights under state insurance privacy regulations and consumer protection laws. These rights may include the right to access, correct, or delete personal information, the right to know what personal information is shared and with whom, and the right to opt out of certain data sharing. To exercise any of these rights, please contact us as described in Section 14. We will respond within the timeframe required by applicable law.
Section 12If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):
To submit a verifiable consumer request, contact us using the information in Section 14. We will verify your identity before responding. Authorized agents may submit requests on your behalf with written authorization.
Note: Certain information we hold may be exempt from CCPA rights under the GLBA exemption applicable to financial institutions.
Section 13We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last Updated" date at the top of this Policy and, where appropriate, notify you by email or prominent notice on our Site. Your continued use of our Site or Services after the effective date of any changes constitutes your acceptance of the updated Policy.
