Introduction and Scope

Klinix Capital Insurance Inc. ("Klinix Capital Insurance," "KCI," "we," "us," or "our") is a licensed insurance agency organized under the laws of the State of Delaware and licensed to transact insurance business in Texas (TDI License No. 3480549, NPN 22164426). This Privacy Policy describes how we collect, use, share, and protect personal information obtained through our website at klinixcapitalinsurance.com (the "Site") and in connection with the insurance products and services we offer (collectively, the "Services").

This Policy applies to consumers, insurance applicants, policyholders, and visitors who interact with our Site or inquire about our Services. By accessing or using our Site, you acknowledge this Privacy Policy. If you do not agree, please do not use our Site or Services.

Capitalized terms not defined herein have the meanings ascribed in the Klinix Capital Insurance Terms of Service.

Section 02

Limitations on Use by Minors

Our Site and Services are intended for individuals who are at least eighteen (18) years of age. We do not knowingly collect personal information from persons under the age of thirteen (13). If we learn that we have collected personal information from a minor under 13, we will take reasonable steps to delete such information promptly.

If you are under sixteen (16) years of age and believe we hold information about you, you may request removal by contacting us at the address below with the subject line "Removal of Minor Information."

Consumer Financial Privacy (GLBA / NAIC Model #672)

As a licensed insurance agency, we are subject to the Gramm-Leach-Bliley Act (GLBA) and the NAIC Privacy of Consumer Financial and Health Information Regulation (Model #672), adopted by Texas and other states where we operate. These laws require us to provide you with notice of our privacy practices with respect to nonpublic personal financial information ("NPI").

We collect NPI from you directly and from third parties including insurers, credit reporting agencies, and public records, including:

• Information you provide on insurance applications, enrollment forms, and contact requests (name, address, date of birth, Social Security Number, income, employment)
• Information about your insurance coverage, policy numbers, premiums, claims history, and payment history
• Information we receive from insurers, agents, healthcare providers, or employers in the course of processing your insurance application or policy
• Transaction information (payments, premium transactions, billing information)

— Sharing of NPI

We may share your NPI with nonaffiliated third parties only as permitted by law, including:

• Insurance carriers and underwriters to whom we submit your application or on whose behalf we service your policy
• Reinsurers, TPAs, and claims administrators in connection with your coverage
• Service providers who perform functions on our behalf (data processing, mailing, technology services) under confidentiality agreements
• As required by law, legal process, or government authority

We do not sell your NPI to marketers or share it for joint marketing purposes without your consent, except as permitted under applicable law.

— Your Opt-Out Rights (GLBA)

To the extent we share NPI with nonaffiliated third parties for purposes beyond those described above, you have the right to opt out. To exercise this right, contact us using the information in Section 14. We will comply with your opt-out request within a reasonable time.

• Device and browser information — IP address, browser type, operating system, device type
• Usage data — pages visited, time spent on pages, referring URLs, click patterns

— Information from Third-Party Sources

• Insurance application processing — information from insurers, MIB, credit bureaus, and public records when you authorize an application
• Business verification services — to verify the identity and credentials of businesses and their representatives

How We Use Personal Information

Purpose	Description
Insurance Services	Processing insurance applications, obtaining quotes, binding coverage, servicing policies, and processing claims on your behalf.
Communications	Responding to inquiries, sending policy documents, renewal notices, and service communications required by law or contract.
Legal Compliance	Complying with applicable insurance laws, state DOI requirements, GLBA, HIPAA (where applicable), and other regulatory obligations.
Fraud Prevention	Detecting, investigating, and preventing fraudulent or unauthorized activity.
Business Operations	Internal analytics, improving our website and services, training, and quality assurance.
Marketing	Sending information about our products and services where you have consented or where permitted by law. You may opt out at any time.

Section 06

Disclosure of Personal Information

We may share your information in the following circumstances:

• Insurance Carriers and Wholesalers — to obtain quotes, bind coverage, and service your policies
• Regulatory Authorities — Texas Department of Insurance, other state DOIs, and law enforcement as required by law
• Service Providers — third-party vendors performing services on our behalf under data protection agreements
• Business Transfers — in connection with a merger, acquisition, or sale of our business, with appropriate confidentiality protections
• Legal Proceedings — when required by subpoena, court order, or legal obligation
• With Your Consent — for any other purpose with your explicit consent

We do not sell personal information to data brokers, advertisers, or marketing aggregators.

Section 07

Your Choices and Control

— Access and Correction

You may request access to, or correction of, personal information we hold about you by contacting us as described in Section 14.

— Marketing Opt-Out

You may opt out of marketing communications at any time by following the unsubscribe link in any email we send, or by contacting us directly. Opting out does not affect transactional or service communications required by law or contract.

— GLBA Opt-Out

To opt out of sharing your NPI with nonaffiliated third parties beyond those described in Section 03, contact us using the information in Section 14.

Section 08

Browser and Platform Controls

• Cookie controls — Most browsers accept cookies by default. You may adjust browser settings to delete or block cookies. See our Cookie Policy for details.
• Global Privacy Control (GPC) — We will make reasonable efforts to honor GPC signals as an opt-out of data sharing where required by applicable law.
• Do Not Track — Our Site does not currently respond to browser DNT signals. Use cookie controls and GPC instead.
• Email web beacons — You may prevent automatic image loading in your email client to disable tracking pixels.

Section 09

Data Retention and Security

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, comply with applicable law (including state insurance record retention requirements, which typically require policy records to be retained for a minimum of five years), resolve disputes, and enforce our agreements.

We implement administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, use, disclosure, alteration, or destruction, consistent with the NAIC Insurance Data Security Model Law (#668) and the GLBA Safeguards Rule. These include encrypted data transmission, access controls, and regular security assessments.

In the event of a data breach involving your personal information, we will notify you as required by Texas Business & Commerce Code Section 521.053 and any other applicable state breach notification law.

Section 10

HIPAA and Health-Related Information

As a licensed insurance agency that assists clients with health insurance placement, Klinix Capital Insurance may receive information that constitutes Protected Health Information (PHI) as defined under HIPAA when acting as a Business Associate of a covered entity (such as a health insurance carrier or employer-sponsored group health plan). In such capacity, we use and disclose PHI only as permitted under applicable Business Associate Agreements and HIPAA regulations.

Our separate HIPAA Notice of Privacy Practices describes our obligations and your rights with respect to PHI.

Section 11

State-Specific Privacy Rights

Residents of certain states have additional privacy rights under state insurance privacy regulations and consumer protection laws. These rights may include the right to access, correct, or delete personal information, the right to know what personal information is shared and with whom, and the right to opt out of certain data sharing. To exercise any of these rights, please contact us as described in Section 14. We will respond within the timeframe required by applicable law.

Section 12

California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):

• Right to Know — the categories and specific pieces of personal information we have collected about you
• Right to Delete — request deletion of personal information we hold about you, subject to legal exceptions
• Right to Correct — request correction of inaccurate personal information
• Right to Opt Out of Sale/Sharing — we do not sell or share personal information for cross-context behavioral advertising
• Right to Limit Use of Sensitive Personal Information — to the extent we process sensitive PI beyond what is necessary for our core services
• Right to Non-Discrimination — we will not discriminate against you for exercising your privacy rights

To submit a verifiable consumer request, contact us using the information in Section 14. We will verify your identity before responding. Authorized agents may submit requests on your behalf with written authorization.

Note: Certain information we hold may be exempt from CCPA rights under the GLBA exemption applicable to financial institutions.

Section 13

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last Updated" date at the top of this Policy and, where appropriate, notify you by email or prominent notice on our Site. Your continued use of our Site or Services after the effective date of any changes constitutes your acceptance of the updated Policy.
